Your Privacy Matters: This Privacy Policy explains how CloudFran, LLC ("we", "us", or "our") collects, uses, discloses, and protects your information when you use the CloudFran Agents platform ("the Service").
1. Information We Collect
We collect information to provide, manage, and improve our Service. This includes:
1.1 Information You Provide
Account details (name, email, phone, business name), billing information, communications with our support team, and any content or data you upload, input, or integrate into the Service.
1.2 Automatically Collected Information
When you access the Service, we automatically collect telemetry and usage data (features used, interaction patterns, session duration), device and network information (IP address, browser type, operating system, device identifiers), and precise or approximate location data derived from your IP address.
1.3 Information from Third Parties
We may receive information about you from third-party partners, identity verification services, and integrated platforms.
1.4 Inferred Data
We may derive information or draw inferences about you based on the data we collect to create a profile reflecting your preferences and characteristics.
1.5 CloudFran AI Presentations Service
When you use the CloudFran AI Presentations service, we also collect and process: presentation content (text, titles, and metadata, sent to the Google Gemini API for AI generation and stored in CloudFran's database); viewer data (email addresses and names provided by viewers during email-verification gates on shared presentations); audience-intelligence analytics (slide-level view duration, scroll depth, forward detection, re-open patterns, device type, browser, and approximate geographic location); and prospect-capture emails (added to CloudFran's prospect database and subject to opt-out). 2. How We Use Your Information
We use the collected information for comprehensive business purposes, including to:
- Provide, maintain, secure, and personalize the Service.
- Process transactions and send related administrative or billing communications.
- Develop and improve the Service, including training, testing, and refining our artificial intelligence, machine-learning models, and algorithms.
- Generate anonymized data. We reserve the right to aggregate, de-identify, or anonymize your data. Once de-identified so that it can no longer reasonably identify you, it is no longer considered personal information and we may use it for any business purpose without restriction.
- Detect, investigate, and prevent fraudulent transactions, unauthorized access, and other illegal activities.
3. Information Sharing and Disclosure
We do not sell your personal information for monetary compensation. We may share information under the following circumstances:
3.1 Service Providers
With trusted third-party vendors operating on our behalf (e.g., cloud hosting, analytics, and payment processing).
3.2 Business Transfers
In the event of a merger, acquisition, bankruptcy, or sale of assets, your data may be transferred as a business asset.
3.3 Legal Obligations
To comply with legal process, subpoenas, or lawful requests by public authorities, or to enforce our Terms of Service and protect the rights, property, or safety of CloudFran, our users, or the public.
3.4 SMS / Mobile Messaging Data
Mobile information — including your phone number and your consent to receive text messages — is never shared with third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent are strictly protected and expressly excluded from every data-sharing category described in this policy. We do not sell mobile opt-in data. 4. Merchant Responsibility for End-User Data (B2B Relationship)
CloudFran provides automation tools for businesses. If you use our Service to process data about your customers ("End-User Data"):
- You are the Data Controller. You bear sole and absolute responsibility for obtaining all necessary consents, providing required privacy notices, and ensuring you have the legal right to collect and share End-User Data with CloudFran.
- CloudFran is the Data Processor. We process End-User Data strictly on your behalf and in accordance with your use of the Service. We disclaim all liability arising from your failure to obtain proper legal consent from your customers.
5. Third-Party Integrations and Liability
Our Service integrates with external platforms (including Twilio, SendGrid, Stripe, and OpenAI). CloudFran exercises no control over, and completely disclaims all liability for, the privacy practices, data security, or potential breaches of any third-party service. Your data shared with these entities is governed solely by their respective privacy policies.
6. Data Security and Assumption of Risk
We implement industry-standard administrative, technical, and physical security measures to protect your data. However, no system, network, or data transmission over the Internet can be guaranteed to be 100% secure. You acknowledge that you provide your personal information at your own risk. To the maximum extent permitted by law, CloudFran disclaims all liability for unauthorized access, use, or disclosure of your information.
7. Data Retention
We retain your information as long as your account is active or as reasonably necessary to fulfill the purposes outlined in this policy. We reserve the right to retain specific data even after a deletion request if it is necessary to comply with legal obligations, resolve disputes, enforce agreements, prevent fraud, or if the data resides in routine, automated disaster-recovery backups where immediate deletion is commercially unfeasible.
8. Your Privacy Rights
Depending on your jurisdiction, you may have the right to access, correct, or request deletion of your personal data. We reserve the right to verify your identity before processing any request and to deny requests that are commercially unreasonable, jeopardize the privacy of others, or are not required by law. 9. Children's Privacy
The Service is restricted to individuals 18 years of age or older. We do not knowingly collect personal information from children under 13. If we discover we have inadvertently collected such data, we will promptly delete it.
10. Dispute Resolution
Any disputes arising out of or relating to this Privacy Policy, including data breaches or privacy violations, are subject to the Binding Arbitration and Class Action Waiver clauses detailed in the CloudFran Terms of Service.
11. International Data Transfers
CloudFran is headquartered in the United States. By using the Service, you explicitly consent to the transfer, processing, and storage of your information in the United States and other jurisdictions, which may have different data protection laws than your country of residence.
12. Changes to This Policy
CloudFran reserves the right to modify this Privacy Policy at our sole discretion, at any time. Material changes will be communicated via the Service or email. Your continued use of the Service after any modification constitutes your acceptance of the updated Policy.
